Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the Vyouizi application and the website at vyouizi.app (the "Service"), operated by Natalia Babkina (Autónomo), NIE Y5479825C, Calle Periodista Gabriel Diaz 3, P.B.I 8, Torremolinos, Málaga, España 29620 ("we", "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. The Service processes photos of a person's face and body, and is not available to minors. By using the Service you confirm you are 18 or older.

3. Your Account

You are responsible for activity under your account and for keeping access to your sign-in method (Apple, Google, or email) secure. Notify us promptly of any unauthorized use.

4. The Service

Vyouizi lets you build a personal try-on model from photos of yourself, add your garments, virtually try those garments on yourself, rotate the result, and receive AI styling suggestions drawn from your own wardrobe. Some features require an active subscription (see Section 5).

5. Subscriptions and Payments

Vyouizi+ is an auto-renewing subscription that unlocks premium features (including full 360° rotation, unlimited try-ons, full-outfit rendering, and higher-resolution sharing).
Subscriptions are sold and processed by Apple through in-app purchase. Payment is charged to your Apple Account.
A free trial, where offered, converts to a paid subscription unless cancelled at least 24 hours before it ends.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
You manage, cancel, or request refunds through your Apple Account settings, subject to Apple's policies. We do not separately process card payments.
Prices may change; we will give notice as required, and changes apply to future billing periods.
Nothing in these Terms limits any mandatory refund or withdrawal rights you have under applicable consumer law.

6. Licence to Use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use, subject to these Terms.

7. Your Content and Rights

You retain ownership of the photos and content you upload ("Your Content").
You represent and warrant that you have the right to upload Your Content, including that you only upload images of yourself or of other people with their explicit consent, and garment images you are entitled to use.
You grant us a limited licence to host, store, and process Your Content solely to provide the Service to you — including transmitting your images to our processors (such as FASHN for rendering and our AI providers for tagging and styling) as described in the Privacy Policy.
We do not claim ownership of Your Content, and we do not use Your Content to train our own or third-party AI models.
You may delete Your Content at any time in the app.

8. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms.

9. AI-Generated Output

Try-on results are AI-generated simulations. They are approximations and may not accurately reflect real fit, size, colour, texture, or appearance. They are provided for visualization and inspiration only, and must not be relied on as a guarantee of how a garment will look or fit in reality.

10. Intellectual Property

The Service, including its software, design, brand, and trademarks (including "Vyouizi" and its logo), is owned by us or our licensors and is protected by law. You may not copy, modify, or create derivative works from the Service except as permitted by these Terms.

11. Third-Party Services

The Service relies on third parties (including Apple, Google, FASHN, and our AI and hosting providers). Your use of those services may be subject to their own terms. We are not responsible for third-party services.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or the Acceptable Use Policy, or where required by law. On termination, the licences granted to you end and we will delete or anonymize your data in line with the Privacy Policy.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate.

14. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or loss of data or profits, arising from your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including your mandatory consumer rights.

15. Indemnification

You agree to indemnify us against claims and costs arising from your breach of these Terms or the Acceptable Use Policy, or from Your Content, including any claim that Your Content infringes a third party's rights (such as another person's image or privacy rights).

16. Governing Law and Disputes

These Terms are governed by the laws of Spain. If you are a consumer, you benefit from the mandatory protections of the law of your country of residence, and you may bring proceedings in the courts of your country of residence. Otherwise, the courts of Málaga, Spain, have jurisdiction.

17. Changes to These Terms

We may update these Terms. We will post the updated version with a new date and, for significant changes, notify you in the app or by email. Continued use after changes constitutes acceptance.
